We have been making some changes at Data Protection Consulting - a new look website and newsletter for 2011. We hope you like them!
Change is in the air for data protection. The European Commission is considering how to upgrade its data protection framework to make it fit for purpose around globalisation and outsourcing issues and to keep it up to date with other developments in data protection law and practice such as the effects of the Lisbon Treaty (which leaves question marks over the applicability of data protection law to justice and policing in most EU states) and the adoption of the Madrid Protocol which seems to go further than current European data protection laws. In the UK we have new powers for the Information Commissioner and more are in the pipeline with the Protection of Freedoms Bill 2011. You can read more about this and changes to the Freedom of Information regime below and if you need any help with data protection or e-commerce issues, give me a call.

Use of Information Commissioner’s new powers to impose significant monetary penalties
Historically the level of fines for data protection breaches has been low. That all changed last year with the implementation of section 144 of the Criminal Justice and Immigration Act 2008 which gives the Information Commissioner new powers to impose significant monetary penalties for serious breaches of the Data Protection Act.

Enhancing the independence of the Information Commissioner’s Office
In February 2011 the Protection of Freedoms Bill was published. Its objectives include reigning in some of the surveillance powers of statutory bodies, setting new parameters for wheel clampers and restricting the categories of persons subject to CRB checks if they have limited contact with children.

Extension of FOI regulation
The latest round of public bodies to be brought under the Freedom of Information regime include the Association of Chief Police Officers, UCAS and the Financial Ombudsman.

Regulation of advertising on websites
Since 1 March 2011 adverts on websites have been subject to ASA regulation. The ASA Copy Advice service is offering website checking services. The British Code of Advertising Practice now covers both paid-for and not-paid-for advertisements on websites such as Facebook.
