For those who wonder about liability for the loss of data due to theft from an employee, in June 2011 North Lanarkshire Council was found to be in breach of the Data Protection Act when a home support worker's bag containing sensitive personal information relating to six vulnerable adults was stolen. The ICO in Scotland found that the guidance provided by the council to its home support workers on the secure storage and disposal of personal information outside the office was inadequate. This emphasises the need for home working procedures to be documented and enforced.
